369 Property is committed to protecting your privacy. This policy explains how we collect, hold, use and disclose your Personal Information. In this policy, 369 Property is a trading name of Climate Hope Pty Ltd.

Can I be anonymous when I deal with 369 Property?

To some extent you can preserve your anonymity when you deal with 369 Property. You can browse our website without providing any Personal Information, access our real-estate advertising in various publications, and generally attend auctions without providing personal details if you do not intend to bid. However, when you enter into transactions with 369 Property (or any other entity owned or run by Climate Hope Pty Ltd), or any client that 369 Property is representing, that involve the sale or purchase of real estate property, 369 Property may need to identify you in order to provide our services.

Who does 369 Property disclose my Personal Information to?

369 Property may disclose your Personal Information:

  • To other owners and representatives of properties;
  • To personnel of 369 Property and Climate Hope Pty Ltd for the purposes of operating our business, fulfilling your requests and providing services to you;
  • To potential acquirers, joint venture partners and similar third parties in the event of a potential or actual merger, restructure or acquisition;
  • Where specific Personal Information needs to be disclosed to protect the safety or vital interests of any person;
  • To a person who represents that they are our customer, only after they verify their identity;
  • If you are a tenant of a property we manage, to Equifax's National Tenancy Database or other tenancy databases;
  • To governmental authorities and regulators for the enforcement of law;
  • To our accountants, lawyers and other advisors engaged to assist us;
  • To any court or tribunal for the conduct of proceedings;
  • To suppliers and third parties with whom we have commercial relationships, for business and marketing purposes;
  • To financial institutions for any authorised purpose with your express consent; and
  • To any persons or bodies where required by law.

We may be bound by law to provide your details to government-related bodies including Titles Queensland or the QLD Office of Fair Trading. 369 Property does not sell your personal details to other organisations, though we may use information about you for internal statistical, marketing and research purposes. 369 Property will not disclose your Personal Information to entities located outside of Australia.

How does 369 Property keep my Personal Information secure?

369 Property takes reasonable steps to ensure personal information it collects, uses or discloses is stored in a secure environment accessed only by authorised persons, to prevent interference, misuse, loss, unauthorised access, modification or disclosure. Information is held in our offices and computer systems, third-party hosting facilities, cloud-based email and CRM providers, and on electronic devices at our offices and our personnel's premises.

We use reputable hosting providers, passwords and access controls, antivirus software, and physical security measures such as locks, visitor access management and alarms. We retain personal information for a minimum period of 3 years in accordance with the Guidelines, after which we take reasonable steps to destroy or de-identify it. You should be aware that electronic storage and transmission of information cannot be guaranteed to be 100% secure.

What happens if I want to access or correct the Personal Information held about me?

You may request access to your Personal Information at any time by contacting us. 369 Property will respond within 14 days and endeavour to provide the requested information within 30 days. We may charge a reasonable fee to cover administrative costs of providing the information, but not for making the request or for correcting your information.

There may be instances where we cannot grant access, for example where doing so may create a serious threat to the life or health of any individual, be an unreasonable intrusion into another's privacy, where the request is frivolous or vexatious, or where access would be unlawful. If we do not allow access, we will provide written reasons. If you believe information we hold is incorrect or misleading, you may request a correction by contacting our Privacy Officer. If we do not agree, we will add a note recording your disagreement.

What if I have a complaint or concern?

What if 369 Property is unable to resolve my complaint or concern?

If we are unable to resolve your complaint to your satisfaction, you may refer the matter to the Office of the Australian Information Commissioner (OAIC).
